A. Business Policy
A.1 INDUSTRIES ITALIA offers products for sale on “moscaclothing.it” and conducts its e-commerce activities.
A.2 INDUSTRIES ITALIA reserves the right not to process orders which does not comply with INDUSTRIES ITALIA's Business Policy.
A.3 These General Terms and Conditions of Sale regulate the offer, transmission and acceptance of purchase orders relating to products on “moscaclothing.it” between the users of mosca.shirt.it and INDUSTRIES ITALIA.
A.4 The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are on “moscaclothing.it” through links, banners or other hypertext links.
Before sending orders and purchasing products and services from those third parties, we recommend that you verify the third party's terms and conditions.
Under no circumstances shall INDUSTRIES ITALIA be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between users of “moscaclothing.it” and third parties.
B. Execute a Purchase Contract
B.1 To place an order for the purchase of one or more products on mosca.shirt.it, you must fill out the online order form and send it electronically to INDUSTRIES ITALIA, following the relevant instructions.
B.2 Please read these General Terms and Conditions of Sale and Returns conditions carefully before ordering any products on “moscaclothing.it”.
At the time of purchase we will provide a brief summary of information of each product ordered with the corresponding prices, terms of delivery and the costs of shipping.
B.3 Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Conditions of Sale, to print a copy using the print option and to save or reproduce a copy thereof for your own personal use.
An order shall be deemed submitted when INDUSTRIES ITALIA receives your order form electronically and the order information has been verified as correct.
B.4 The order form will be filed in our data base for the time required to process your order and as provided by law. You may access your order form by clicking on the section called My Order in the Customer Care area.
B.5 Before submitting the order form, you will be asked to pay the indicated price.
B.6 After your order form has been submitted, INDUSTRIES ITALIA will process your order.
B.7 INDUSTRIES ITALIA may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that INDUSTRIES ITALIA has not carried out your purchase order specifying the reasons thereof.
If the products displayed on “moscaclothing.it” are no longer available at the time of your last access or once INDUSTRIES ITALIA has received your order form,we will inform you of the unavailability of the ordered products within thirty (30) days from the day after we have received your order.
If the order form has been sent and the price has been paid for items that are no longer available, INDUSTRIES ITALIA will refund the amount paid for those items.
B.8 By submitting an order form, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on “moscaclothing.it”.
B.9 By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on “moscaclothing.it” through links, including the General Terms and Conditions of Use and Privacy Policy and Returns.
B.10 Upon submission of an order form, INDUSTRIES ITALIA will send you a purchase order receipt e-mail, containing a summary of the information related to the order form (General Terms and Conditions of Sale, the products' main characteristics, detailed information on price, terms of payment, return policy and shipping costs).
B.11 We would like to remind you that all items purchased are intended for use in the country they were ordered from. If, however, you decide to take the items to another country, you will be responsible for adhering to both the exportation legislation of the order country and the importation legislation of the destination country. INDUSTRIES ITALIA shall not be held liable.
C. Guarantees and Product Price Indication
C.1 Products purchased on mosca.shirt.it are directly produced by INDUSTRIES ITALIA, carefully selected for their stringent quality control.
C.2 INDUSTRIES ITALIA does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.
C.3 The main characteristics of products are shown on mosca.shirt.it on each product page. The products offered for sale may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used.
C.4 Prices are subject to change.
C.5 Orders made from a country site different from the one you are shipping to, or to addresses to which INDUSTRIES ITALIA cannot ship, will be automatically cancelled.
C.6 All Products sold by INDUSTRIES ITALIA come with an identification tag attached with a disposable seal. When trying on the products you should not remove or alter the tag or seal from the purchased products should you wish to return the purchased product.
C.7 INDUSTRIES ITALIA, in case of exercise of your right of withdrawal, may not accept the return or repay the amounts paid, if products are returned without original tag or have been altered or have been damaged.
D. Payments
D.1 Payment of the product prices and relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form. Under no circumstances, INDUSTRIES ITALIA will not charge more than cost incurred by you, in relation to the payment method used.
D.2 In the case of payment by credit/debit card, all details (e.i. card number or expiration date) will be sent by encrypted protocol to Pay Pal, which provide remote electronic payment services, without third parties having any access.
Such details will not be used by INDUSTRIES ITALIA except for performing the procedure relevant to your purchase or issuing refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the relevant costs for shipping and delivery, as indicated in the order form, will be charged to your current account when the purchased products are actually shipped.
E. Value Vouchers / Coupon/ Promotional Codes
E.1 Value vouchers are personalised codes, also referred to as COUPON, which allow you to take advantage of a discount on your purchase on “moscaclothing.it”.
E.2 COUPON is displayed on the first page of the Checkout: after you have inserted your items in the Shopping Chart and entered your code, press New Total. COUPONS are valid for the whole shopping chart (except products on sale) .
E.3 There are some restrictions to the use of COUPONS:
• COUPON can be used only once
• COUPON cannot under any circumstances be exchanged for money
• You may not use more than one COUPON per same order
• COUPON is valid for the whole shopping chart (except products on sale)
• COUPON cannot be applied to any Product on sale
E.4 If for any reason you are not satisfied with your order, you may return the item to which you applied the value voucher by following the standard return procedure, as described in the Returns and Refunds section.
Once your return has been accepted, the respective code will be restored to its original value. The difference in price between the value voucher and the item you purchased will be reimbursed, according to the time frame of the applicable refund procedure.
F. Shipping and Delivery
F.1 For specific product shipping and delivery procedures, please read the Shipping/Return section, within any product page. The information provided in these sections forms an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by you at the time your order form is sent.

H. Right to Return
H.1 Within fourteen (14) calendar days, you have the right to cancel your contract with INDUSTRIES ITALIA in relation to products purchased from mosca.shirt.it, without any penalty and for any reason. Please pay attention to some specific cases, reported in the Return Policy, where you can not receive full refund of the purchased product.
H.2 To cancel your contract you can connect to mosca.shirt.it in MY ORDERS within MY ACCOUNT, and express your decision to withdraw from the contract. You will receive an email for return authorization with instructions. INDUSTRIES ITALIA reserves the right to refuse refunds sent after the set period or for items that are not in the same condition in which you received them or without disposable seal.
H.3 You should return the products to INDUSTRIES ITALIA within five (5) calendar days of the date you notify INDUSTRIES ITALIA of the cancellation.
Please return products to the courier complete with airwaybill precompiled that we'll be attached to the package properly sealed.
H.4 The only expenses charged to you are to return products purchased, and they will not be credited to you.
H.5 Once you’ve contacted the courier indicated by INDUSTRIES ITALIA in the Return Authorization, you do not have to personally pay the costs , at your expense , to return products purchased .
The payment of the expenses of returning the purchased products will be made , on your behalf , directly from the INDUSTRIES ITALIA, which therefore will free your from any obligation to pay to the shipper. INDUSTRIES ITALIA reserves the right to retain the products and the amount shown for the deduction of refund, due to the decrease in value of the returned product.
H.6 Right of return - besides compliance with the conditions described at points H.1 , H.2 , H.3 and H.4 is exercised properly if they are fully respected, the following conditions:
Request of return should be submitted directly online through the website mosca.shirt.it or other unequivocal statement about your decision to withdraw from the contract must be properly completed and provided to INDUSTRIES ITALIA within fourteen (14) calendar days of receipt of goods :
• products must not be damaged
• productw must not be used, worn , washed ;
• identification tag must be still attached to products with the disposable seal;
• products must be returned in their original packaging ;
• products must be delivered to the courier within five (5) calendar days from the day you have communicated to INDUSTRIES ITALIA your decision to return your purchase
H.7 If your Right of Return respect all the procedures and time limits specified in this paragraph H , INDUSTRIES ITALIA shall refund the amounts paid for the purchase of products on the conditions and terms provided.
H.8 Once INDUSTRIES ITALIA warehouse receives your return and verifies the respect of the terms and conditions above , as described in section H , you will receive a confirmation email and the acceptance of the return .
INDUSTRIES ITALIA will credit the total amount (equal to the sum returned items excluding shipping costs) directly to the credit card / PayPal , with which it was paid within fourteen (14) days from the date of receipt of return.
H.9 If conditions and terms for the exercise of your right of retun are not fully complied, you will not be entitled to reimbursement of the money paid to INDUSTRIES ITALIA. Within 14 days of receipt of the products, we will send you an e -mail with which you will be informed of the rejection of the return: you can choose to get back at your expense , the products in the state in which they were returned to INDUSTRIES ITALIA, notifying MCR same in the manner that will be communicated . Otherwise, INDUSTRIES ITALIA will keep the products in addition to sums already paid for their purchase .
I. Deadlines and procedure for obtaining refund
I.1 After returning products , INDUSTRIES ITALIA provides the necessary controls related to compliance with the same conditions and time limits specified in section H. If the checks are successfully concluded, INDUSTRIES ITALIA shall send you by e-mail about the acceptance of returned products . If any of above conditions to return products are not respected, INDUSTRIES ITALIA shall communicate , by e- mail , the non acceptance of the return.
In this case you can choose to get back at your expense , the products in the state in which they were returned to INDUSTRIES ITALIA, notifying INDUSTRIES ITALIA itself, in the manner that will be released, as provided in paragraph H.9 .
Otherwise, INDUSTRIES ITALIA will keep the products in addition to sums already paid for their purchase.
I.2 Whatever method of payment you used , the reimbursement, in whole or in part , is activated by INDUSTRIES ITALIA as quickly as possible and no later than fourteen (14) days from the date on which INDUSTRIES ITALIA became aware of your Right of Retun after verification of returned products.
I.3 INDUSTRIES ITALIA will refund you using the same payment method you used for the purchase of returned products. If there is no correspondence between the recipient of the goods, specified in the order, and who has made the payment, the refound of amounts will be executed to who made the payment .
I.4 INDUSTRIES ITALIA will indicate which courier you can use to return purchased products: BRT (http://www.brt.it/).
You can return the products to INDUSTRIES ITALIA either by:
the approved courier (as indicated on the online Return Form) via the pre-paid, personalized return label, and INDUSTRIES ITALIA shall deduct from your refund the cost of return postage; or by packaging the relevant products securely and sending them, at your own risk and cost, to INDUSTRIES ITALIA using your return number (as provided via the online Return Form). For your protection, we recommend that you use a courier service if you choose to return the goods other than via the pre-paid mechanism and approved courier.
I.5 If you prefer you can send the return at your expense, with a courier of your choice. We are not responsible for any loss or damage to your merchandise if you ship your return without using INDUSTRIES ITALIA approved courier.

K. Governing Law e Disputes
K.1 The General Terms and Conditions of Sale are governed by Italian law.
K.2 In case of disputes arising from The General Terms and Conditions of Sale between the INDUSTRIES ITALIA and its end users, that can not be friendly solved with an e -mail to our info@industriesitalia.it , all legal proceedings shall be brought solely in the city of Treviso, Italy.
L. Modification and Updating
L.1 INDUSTRIES ITALIA reserves the right in its sole discretion to make changes to these General Terms and Conditions of Sales at any time and without specific notice to you. By using our Site ““moscaclothing.it” after any such change, you agree to comply with and be bound by these General Terms and Conditions of Sales as changed.
INDUSTRIES ITALIA reserves the right in its sole discretion to edit, delete or otherwise modify any documents, information or other content appearing on our Site “moscaclothing.it”.
